检察权是一项国家权力。我们在研究检察权的性质时必须以宪政制度为基础。本文通过宪政这个视角,在明确了三权分立政治模式下的检察权属性的基础上着重分析了我国当前检察权的性质,得出我国的检察权是一项兼具司法权属性和法律监督权属性的独立的国家权力,并指出当前我国检察体制中存在的问题,最后提出具体的改革设想。
Prosecutorial power is a national power. When we study the nature of prosecutorial power, we must base our constitutional system. Based on the perspective of constitutional government, this article emphatically analyzes the nature of procuratorial power in the political model of the separation of powers and analyzes the nature of procuratorial power in our country.
