最高人民法院根据修改后的《法官法》的有关规定,[1]在2002年7月18日发布的《关于加强法官队伍职业化建设的若干意见》中第25条明确提出要在我国实行法官定额制度。[2]然而此项制度的建立作为我国法官职业化建设的一项重要内容,受诸多因素的影响,尤其涉及我国现行人民法院体制的诸多方面。因此,法官定额制度的建立必须以人民法院的体制改革为前提,并与法院的体制改革同步进行。 一、中国法官现状分析 研究法官定额制度的第一个前提就是对我国法官队伍的现实状况进行科学的分析。最新统计资料表明,我国现有法官21万人,[3]但这21万余名法官中的相当一部分并非真正意义上的法官。之所以形成这样的局面,在很大程度上是由于我国现行法官管理体制存在弊端。我们主要从三个方面进行一些分
According to the revised “Judicial Law”, the Supreme People’s Court stated in article 25 of “Several Opinions on Strengthening the Professionalization of Judicial Ranks” promulgated on July 18, 2002, that it is explicitly proposed to implement a judge in our country Quota system. However, the establishment of this system as an important part of the professionalization of judges in our country is affected by many factors, especially the many aspects of the current system of people’s courts in our country. Analysis of the Current Situation of Chinese Judges The first prerequisite for the study of the system of judges’ quotas is to conduct a scientific analysis of the current situation of the ranks of Chinese judges.
