现代陪审制度是普通民众参与国家审判活动的重要法律制度,是体现当代司法民主和公民司法参与权的保障性制度。而民意又是支撑司法大厦的基石,陪审制度是让民意有序地融入司法最为有效的形式。在审判模式改革日益深入的当下,笔者从我国人民陪审员制度的历史沿革入手,深入比较两种陪审制度以期对我国人民陪审员制度改革有所启迪。
The modern jury system is an important legal system for ordinary people to participate in state trial activities and is a guarantee system that reflects the right of contemporary judicial democracy and citizens to participate in judiciary. And public opinion is the cornerstone of the judicial building. Jury system is the most effective way to get the public opinion into orderly manner. With the deepening of the trial mode reform, the author starts with the historical evolution of the people’s jury system in our country and compares the two kinds of jury system deeply in order to give some inspiration to the reform of the people’s jury system in our country.
