造成物业管理纠纷在于物业管理执行监管环节的缺失,尤其当物业管理企业与业主的利益处在不一致的状态中时。特别是法律、法规还未涉及的“真空地带”,就需要在“物业管理企业”与“业主”之间建立一个监察、协调、调解机制,由“第三方”充当调解人。这样的第三方机构应该采用市场化的运营模式,与物业管理的市场化相呼应,顺应行业发展的大趋势,最终通过市场化的方式成功解决物业管理纠纷。
Dispute of property management lies in the lack of supervision of property management implementation, especially when the interests of property management companies and owners are in an inconsistent state. In particular, the “vacuum zone” not covered by laws and regulations needs to establish a monitoring, coordination and mediation mechanism between the “property management enterprises” and the “owners”, and the “third party” acts as the mediator. Such third-party agencies should adopt the market-oriented operation mode, echo the marketization of property management, conform to the general trend of development of the industry, and finally successfully resolve property management disputes through the market-oriented approach.
