商标作为一种标识,常常代表一个企业的形象,由于商标的巨大经济效益,使企业商标之间的相互模仿增多,判断商标是否近似是商标侵权认定中的难点,也是国家商标确权机关在商标注册申请审查、商标案件审理过程中经常要考虑的问题。所以对商标的近似性进行分析和界定,这样既能保护优质产品,也能保护消费者、生产者、销售者的合法权益,最重要的是能促进社会主义市场经济向良性化发展。
As a kind of logo, trademark often represents the image of an enterprise. Because of the huge economic benefits of a trademark, the mutual imitation between enterprises’ trademarks increases.
