世界贸易组织(WTO),是世界经济全球化过程中的最重要的产物,其拥有135个成员,是当今世界最具影响的经济联合体,也是解决世贸组织成员间贸易争端最主要的国际组织。中国经过多年的谈判,终于在2001年加入WTO,成为其成员国之一。这意味着中国承诺接受WTO的全部规则,并将这整套规则渗透至我国的经济、文化及社会生活的方方面面。这一深刻变化,不但使中国的市场经济体制有了新的发展方向,而且要求中国的司法职能也必须做出相应的调整,以保证中国的入世承诺得以实现。本文详细介绍了WTO规则的特定及各国司法实践对其适用的模式,从而探讨我国目前对WTO规则的适用情况,并提出自己一些观点。
The World Trade Organization (WTO) is the most important product of the globalization of the world economy. It has 135 members and is the most influential economic union in the world today. It is also the most important international organization that resolves trade disputes among WTO members . After years of negotiations, China finally joined the WTO in 2001 and became one of its member countries. This means that China is committed to accepting all the rules of the WTO and infiltrating this set of rules into all aspects of our economy, culture and social life. This profound change has not only given China a new direction of market economic development, but also requires that China’s judicial functions must be adjusted accordingly so as to ensure that China’s WTO accession promise can be realized. This article introduces in detail the specific rules of WTO rules and the applicable modes of judicial practice in various countries so as to explore the current application of WTO rules to our country and put forward some views of our own.
