继中央出台“八项规定”、“六项禁令”后,餐饮业的经营业绩不断下滑,生存环境日趋严峻。而2013年12月9日,北京市工商局出台的关于整改北京市餐饮行业的六条“不公平格式条款”的意见,无疑使已处于寒冬之中的餐饮业雪上加霜。取消“禁止自带酒水”、“包间最低消费”等条款一出,立即引起了相关机构的注意。这意味着餐饮业自主经营权的全面萎缩,但从另一个方面也对我国餐饮行业现有的经营管理模式和盈利结构提出了新的挑战。以工商局为代表的政府和以行业协会为代表的餐饮业在这一问题上展开了积极论战,专业人士、社会媒体也对这一问题各抒己见。一时间,支持整改“霸王条款”和支持餐饮业维护自身权益的观点擦出了激烈的火花。作为行业媒体,我们始终关注这一事件的发展进程,并通过展现双方争论的焦点和利益诉求,力图找到一条解决争议的路径。
Following the promulgation of the Central Government, “Eight Provisions” and “Six Prohibitions,” the operating performance of the catering industry has been declining continuously, and the living environment has become more and more serious. However, on December 9, 2013, the opinions of Beijing Administration for Industry and Commerce on rectifying and reforming the six “unfair format clauses” in the catering industry in Beijing undoubtedly made the catering industry already in the middle of the winter worse. Cancel “banned bring your own ”, “minimum consumption between rooms ” and other terms, immediately aroused the attention of the relevant agencies. This means that the autonomy of the catering industry has been declining in its entirety, but on the other hand, it has also posed new challenges to the existing management and profit-making structure of China’s catering industry. The government represented by the Trade and Industry Bureau and the catering industry represented by trade associations have conducted active debates on this issue. Professionals and social media also express their opinions on this issue. For a time, support for rectification “King terms ” and support the restaurant industry to safeguard their own rights point of view wiped out a fierce spark. As an industry media, we are always concerned about the development of this incident and are trying hard to find a way to resolve the dispute by showing the focus and interests of both parties.
