劳动合约是农民工形态人力资本质量提升和发展和谐劳动关系的制度保证。本文基于新制度经济学思想,从农民工劳动合约的关系网络特点出发,构建适于我国农民工劳动合约关系的框架结构,从纵向和横向两个维度分析制约农民工劳动合约制度实施的各种关系结构,提出三方机制中政府主导作用的要求。
Labor contract is the institutional guarantee for improving the quality of migrant workers’ human capital and developing harmonious labor relations. Based on the new institutional economics, starting from the network characteristics of migrant workers ’labor contracts, this paper constructs a framework that is suitable for the contractual relationship of migrant workers in China and analyzes the various aspects that restrict the implementation of the system of migrant workers’ labor contracts from the vertical and horizontal dimensions Relationship structure, and put forward the requirements of the government’s leading role in the tripartite mechanism.
