物权变动,即物权的取得、变更、移转、消灭的动态过程。目前大陆法系国家将物权变动模式划分为三种:债权意思主义,物权形式主义,和债权形式主义。笔者设立了三项标准用以检验物权变动模式是否适合当下中国,对三种模式进行利弊比较,从而得出结论。 Property changes, that is, the acquisition, change, transfer, elimination of the dynamic process of property rights. At present, civil law countries divide real estate ownership into three types: creditor’s rights doctrine, real rights formalism, and claims formalism. I set up three criteria to test whether the change of real right model for the present China, the pros and cons of the three models were compared to draw conclusions.
