由于学生基本权利的不可侵犯性与学校自主管理的教育规律,司法介入公立学校管理存在一定的限度。这具体表现为三个方面:涉及基本权利的管理行为方属于司法介入范围;复议前置程序是司法介入的前提条件;程序审查是司法审查的主要标准。只有如此,学校管理、学生权利与司法独立三者之间才能保持良性互动。
Due to the inviolability of students’ basic rights and the education rules autonomously administered by schools, there is a certain limit to the administration of justice in public schools. This is manifested in three aspects: the administrative parties involved in fundamental rights belong to the scope of judicial intervention; the review of pre-proceedings is a prerequisite for judicial intervention; and the review of procedures is the main criterion for judicial review. Only in this way can we maintain a benign interaction between school management, student rights and judicial independence.
