刑讯逼供是指司法工作人员采用肉刑或变相肉刑折磨被讯问人的肉体或精神,以获取其供述的一种极恶劣的审讯方法。刑讯逼供是一个国家司法不文明的标志之一,但不幸的是,在倡导法制现代化,建设社会主义法治国家,构建和谐社会的今天,又一个因刑讯逼供造成的错案——河南商丘赵作海案发生了。本文拟通过分析刑讯逼供的成因、危害结果,对遏制刑讯逼供的途径和对策进行探索和分析。
