一、问题的提出在日常的报纸杂志上,我们经常能看到某知名生产商因限定其经销商的最低转售价格被指控涉嫌纵向垄断。纵向垄断是指在不具有竞争关系的产业链前后向经营主体间达成的排除、限制竞争的协议、决定或其他协同行为,限定转售最低价格是其最普遍的表现形式。纵向垄断相较横向垄断来说,具有隐蔽性强,不易察觉,危害程度和范围大等特点,会加大全社会的竞争成本,造成经济运行的低效率,服务质量低下、滋生腐败等一系列负面影响。为此,我国于2008年颁布了
