隐匿身份侦查指的是侦查人员或受委托侦查的人员隐匿其真实身份实施的侦查。隐匿身份侦查的实践必要性表现在:隐匿身份侦查是对传统侦查措施困境的回应;隐匿身份侦查是实体真实和程序公正的需要;隐匿身份侦查是社会“正义”实现的需要。隐匿身份侦查的道德和操作风险包括:隐匿身份侦查目的性的片面化风险;隐匿身份侦查的价值取向的单一化风险;隐匿身份侦查监督控制的弱化风险。隐匿身份侦查的道德许容性和实践控制可能性为:隐匿身份侦查的确定性;隐匿身份侦查的内在意义;隐匿身份侦查与现代司法体系的贴切性。
Occult identity detection refers to the investigation of investigators or commissioned investigators hiding the implementation of their true identity investigation. The necessity of concealed identity investigation is manifested in the following aspects: the concealed identity investigation is a response to the predicament of traditional investigation measures; the concealed identity investigation is the need of real entity and procedural fairness; the concealed identity investigation is the need of social “justice ”. The morality and operational risks of identity detection include: the one-sided risk of the purpose of identity detection; the simplification of the value orientation of identity detection; and the risk of weakening the identity supervision. The possibility of concealing the identity of moral detection and the possibility of practice control are as follows: the certainty of concealment of identity investigation; the intrinsic meaning of concealed identity investigation; the cogency of concealing identity investigation and modern judicial system.
