时下有一种流行的观念认为,立法机构和独立司法体系面对行政部门越强势、制衡越强,就越能有效消除腐败,提高效率。这种观点忽略了,权力泛化的司法体制实际上蕴藏着较大的反腐败损害经济增长的潜在风险。“依法治国”不是“法院治国”。
At a time when there is a popular belief that the more powerful the legislature and an independent judiciary in the face of the executive branch and the stronger the checks and balances, the more effective the elimination of corruption and the enhancement of efficiency. Ignoring this view, the generalized judicial system of power actually contains a larger potential risk of anti-corruption undermining economic growth. “Administering a country according to law” is not “governing a country by a court”.
