海事赔偿责任限制一般是针对一次事故所引起的各种索赔的综合性的责任限制。因而,也常常被称为“综合(责任)限制”。海事赔偿责任限制是指在发生重大海损事故时,作为责任人的船舶所有人、经营人和承租人等,可根据法律的规定,将自己的赔偿责任限制在一定范围内的法律制度。相关国际公约和我国海商法都规定了承租人可以享受海事赔偿责任限制,但是具体哪些承租人可以成为海事赔偿责任限制的主体,公约和我国海商法均未明确规定。本文认为新出现的集装箱箱位承租人可以享受海事赔偿责任的限制的保护,并分析了其原因。
Limitation of liability for maritime claims is generally a comprehensive limitation of liability for the various claims arising from an incident. Therefore, it is also often referred to as “Consolidation (Liability) Limit ”. Limitation of liability for maritime claims means that the owners, operators and charterers as the responsible persons in case of major maritime damage accidents may, under the law, limit their liability to a certain extent within the legal system. Relevant international conventions and China’s maritime law stipulate that lessees may enjoy the limitation of maritime claims. However, the specific lessees can become the subject of limitation of maritime claims, and neither the convention nor China’s maritime law explicitly stipulate. This paper argues that the emerging container tenant can enjoy the limitation of maritime liability and analyze the reason.
