民事诉讼作为现今现代法治建设和发展的重要环节和实现工作之一,随着现代法治公平与正义核心理念的践行实施,实体正义和程序正义也是成为现代法治工作开展齐头并进的两个重要的工作方向。那么,践行程序正义工作最为重要的则是能够保证民事诉讼证据运用的真实性、合法性和规范性,基于这一方面而言,对民事诉讼中的非法证据进行排除则是非常必要的。浅析民事诉讼非法证据的排除规则,对于实际法治工作的创新改进有着非常重要的借鉴意义。
As one of the important links and realization tasks in the modern construction and development of the rule of law, with the implementation of the core concept of fairness and justice in modern law and order, substantive justice and procedural justice are also two important tasks of making progress both in modern law and order direction. Then, the most important thing to do in procedural justice is to ensure the authenticity, legitimacy and normativity of the evidence in civil litigation. For this reason, it is necessary to exclude the illegal evidence in civil litigation. Analysis of the rule of exclusion of illegal evidence in civil proceedings has very important reference for the innovation and improvement of the actual rule by law.
