在执行实务中,不动产因其价值较大、转让程序烦琐(甚至难以转让)、转让周期长等特点,往往成为法院执行工作的突破口。但是,我国现行的法律制度在农村房地产这一领域存在大量的法律真空,事实上主要靠国家的政策性文件进行调整。这既给理论界留下了很多争论,也给执行工作带来很多困惑。本文以司法实务为视角,围绕农村宅基地及其地上建筑物在执行过程中遇到的“一户一宅”、宅基地转让、宅基地(地上有房屋或无房屋)拍卖、“房地一体”问题进行分析探讨,以期为解决当前在农村房地产领域执行过程中所遇到的困境提供一些思路与参考。
In practice, real estate often becomes the breakthrough point for the implementation of the court because of its large value, cumbersome transfer procedures (even difficult to transfer) and long transfer period. However, the current legal system in our country has a large number of legal vacancies in the realm of rural real estate. In fact, it mainly depends on the state’s policy documents. This not only left a lot of controversy for theorists, but also brought a lot of confusion to the implementation.
