新婚姻法修改后引入了离婚补偿请求权的规定,这一规定有助于解决约定财产各自所有而夫妻双方所尽家庭义务明显不对情况下,财产分配不公的问题,但规定得过于简单,对于离婚补偿请求权的性质,行使要件,举证责任,补偿标准等,都存在空白,势必给司法实践带来困难。本人试通过对离婚补偿请求权概念、立法目的、性质的解析来构建其形式要件,并在举证规则和补偿标准问题上提出建议。
The new Marriage Law introduced the requirement for the right of divorce compensation. This provision helps to solve the problem of unfair property distribution under the condition that the family obligations agreed upon by both parties are obviously different, but the provisions are too simple. I attempt to construct the formal elements of the concept of the right to divorce claims, the purpose and nature of the legislation, and make recommendations on the rules and standards of proof.
