收费公路权益转让在深化我国公路项目投融资体制改革的过程中所取得的成就有目共睹,它不仅缓解了政府投资公路建设资金严重不足的压力,还极大地提高了广大社会资本投资公路产业的积极性。但是,我国收费公路权益转让也存在着滥用转让模式、转让价格形成缺乏科学依据、监管效率低下等问题,导致了国有公路资产的流失。究其原因,主要是收费公路权益转让的利益相关者之间存在利益冲突、转让价格评估的限制因素多、转让的监管体系尚未建立。因此,有必要从规范收费公路权益的转让模式、完善转让的价格评估方法、建立收费公路权益转让监管体系三个角度出发提出对策,规范转让行为,促进我国收费公路权益转让的发展。
The achievements made in the transfer of rights and interests of toll highways during the process of deepening the reform of the investment and financing system of highway projects in China are obvious. It not only relieves the pressure of serious shortage of government investment in highway construction, but also greatly enhances the enthusiasm of social capital investment in the highway industry. However, the transfer of rights and interests of toll highways in China also has some problems such as the abuse of transfer model, the lack of scientific basis for the formation of the transfer price, and the inefficiency of supervision, resulting in the loss of state-owned highway assets. The reason is that there are conflicts of interest among stakeholders involved in the transfer of rights and interests of toll roads. There are many restrictions on the assessment of the transfer price, and the regulatory system of transfer has not yet been established. Therefore, it is necessary to put forward countermeasures from the perspectives of regulating the transfer mode of toll road rights, improving the evaluation method of transfer price and establishing supervision system of transfer of rights and interests of toll roads, regulating transfer behavior and promoting the development of rights transfer of toll road in our country.
