《婚姻法》第16条规定:夫妻双方都有实行计划生育的义务。“计划生育”作为公民的一种法定义务,规定在《婚姻法》中引起了广大学者的关注,本文以《婚姻法》的私法属性为基点,就生育权的内容、取得、限制等相关法律问题展开了论述。
Article 16 of the Marriage Law stipulates that both spouses shall have the obligation to practice family planning. “Family Planning ” as a statutory obligation of citizens stipulates the concern of the majority of scholars in the Marriage Law. Based on the private law attributes of the Marriage Law, this article takes into consideration the relevant laws on the content, acquisition and restriction of the right to reproductive rights The problem has been discussed.
