行政合同作为行政行为之一种,目前在中国行政实务界已得到普遍认同、应用和推广。但我们现在却面临一个尴尬的局面——行政合同在实践中广泛运用,可是立法及理论研究却相对滞后。在法律缺失的情况下,研究行政合同的原则显得十分必要也十分重要。为了突出行政合同特点、限制行政主体的“特权”、维护公共利益和保护行政相对人合法权益,行政主体与行政相对人缔结行政合同时应遵循:法定原则、合意原则、公开竞争原则、公益优先原则、诚实与信赖保护的原则和全面履行原则。
As one of the administrative acts, the administrative contract has been generally accepted, applied and popularized in the field of administrative practice in China. However, we now face an awkward situation - administrative contracts are widely used in practice, but the legislation and theoretical research are lagging behind. In the absence of law, it is necessary and important to study the principle of administrative contract. In order to highlight the characteristics of the administrative contract, restrict the “privilege” of the administrative subject, safeguard the public interest and protect the legitimate rights and interests of the counterpart of the administrative party, the administrative subject should follow the statutory principle, the principle of agreement, the principle of open competition, The principle of giving priority to public welfare, the principle of honesty and trust protection, and the principle of full implementation.
