宅基地使用权是农民一项重要的土地权利,但是宅基地使用权流转立法现状及实践现状存在诸多问题。首先,法律对宅基地使用权流转的限制导致农村大量宅基地闲置,土地使用权隐形流转市场日益滋生;其次,关于宅基地方面的法律法规存在相互冲突、立法体系缺失,实践试点中也存在利益分配问题、农民的社会保障问题。通过对宅基地使用权流转问题分析,提出了构建宅基地使用权流转的基本内容,为宅基地使用权流转提供有力的法律保障,为农民拓宽增加收入的渠道。
The right to use house sites is an important land rights for peasants. However, there are still many problems in the status quo and practical status of the legislation on the circulation of the right to use homestead land.
