作为一种社会规范,商会组织自律规范是一种团体法,一种软法。从章程类、自律公约类与标准类三方面对商会组织自律规范进行类型化整理,章程是商会自治的宪章,自律公约是商会会员的职业道德准则,标准是行业内产品与服务质量的硬约束。商会组织自律规范的约束力是一种不必由国家强制力量保障其实施的柔性约束力,其内容主要体现在适用对象与惩戒规则上。
