本文从司法领域出发,研究运用外国法、进行法律移植的实践和理论。中外已有不少关于运用外国法改善或完善本国法的论述,但仍需在理论上和实践上进一步探索。此外,在司法中被运用的法,都是行动中的法,被移植的法律能否在新的土壤中起作用,其效果如何,就变得格外重要。作者通过分析对比欧美国家和中国的具体案例,提山了中国司法过程中运用外国法时需要思考的几个问题。
Based on the judicial field, this paper studies the practice and theory of using foreign law and carrying on legal transplantation. There are a lot of expatiations on improving or perfecting the national law by using foreign laws both at home and abroad, but still need to be further explored theoretically and practically. In addition, the law that is applied in the judiciary is the law in action. Whether the transplanted law can play its role in the new soil or not will become especially important. By analyzing and comparing specific cases of Europe, the United States and China, the author puts forward several questions that need to be considered when using foreign law in China’s judicial process.
