工商资本进入农业领域,推动了如今农业的现代化进程,拓宽了农村的发展视野,增加了农民收入的渠道,对农产品种植规模的扩大与我国农产品供应的保证起到了重要的促进作用。因此,如何从法律层面对资本下乡行为进行规制,引导和促进工商资本在投资农业方面最大程度地发挥作用就显得尤为重要。本文以我国目前工商资本下乡的实际现状为基础,探讨现如今资本下乡过程中法律规制存在的不足,并对我国工商资本下乡在法律规制方面提出完善建议。
The entry of industrial and commercial capital into agriculture promoted the modernization of agriculture nowadays, broadened the horizon of rural development and increased the channels of income for peasants, which played an important role in promoting the expansion of the scale of agricultural products and the guarantee of the supply of agricultural products in our country. Therefore, how to regulate the behaviors of capital going to the countryside from the legal aspect and guide and promote the maximum use of industrial and commercial capital in the investment of agriculture is particularly important. Based on the current actuality of China’s industrial and commercial capital going to the countryside, this article explores the shortcomings of legal regulation in the process of capital going to the countryside nowadays and puts forward some suggestions on legal regulation of industrial and commercial capital in our country.
