国家作为一方当事人参与国际投资活动、发生争议诉诸仲裁后,在执行仲裁裁决的过程中就有可能出现国家豁免抗辩的问题。对绝对豁免和限制豁免的不同适用会使类似案件得到不同的判决结果,但是限制豁免还未形成为习惯国际法。仲裁过程中国家豁免的放弃并不同于诉讼过程中管辖豁免和执行豁免的放弃,后者需要单独的声明。外交财产、央行财产以及军事、文化等财产一般享有执行豁免权,其他的财产则可能因为商业用途或者非主权目的而不能得到豁免。
When a country participates in international investment activities as a party and resorts to arbitration after a dispute arises, the issue of state immunity may arise during the enforcement of the arbitral award. The different application of absolute immunity and limited immunity would give different sentences in similar cases, but the restriction of immunity has not yet been formed into customary international law. The waiver of state immunity during the arbitration is not the same as the waiver of jurisdictional immunity and enforcement immunity during the proceedings, which require a separate declaration. Foreign property, central bank property and military and cultural property generally enjoy immunity from execution, and other properties may not be exempted for commercial or non-sovereign purposes.
