1981年10月,枣阳市耿集镇九龙村一组(下称九龙村一组),通过村民会议,将套种有黄花、小麦的70亩桔园发包给耿守东等三户村民承包。合同约定承包指标为:黄花上交500元,每年按5%递增;小麦每年上交1000斤;桔树见收益后与九龙村一组按各50%分成。承包期为“联产几年合同延续几年”。此外,合同还约定了承包人的口粮分配和义务工等条款。 1982年,双方按合同履行。但承包人完成第一年上交指标后,九龙村一组负责人认为上交的实物不好管理和分配,便与承包人口头商定,不再按合同上交
In October 1981, a group of Jiulong Village, Gengji Town, Zaoyang City (hereinafter referred to as a group of Jiulong Village), contracted by way of villagers’ meeting an outsourcing of 70 mu of orange groves interplanted with yellow flowers and wheat to three villagers including Geng Shou-Dong. Contractual contracted indicators for the contract: Huanghua turned over 500 yuan, an annual increase of 5%; wheat every year handed over 1,000 pounds; orange trees see income and Jiulong Village, according to a 50% share. The contract period is “several years of co-production contract extension of a few years.” In addition, the contract also stipulated contractor’s rations and volunteer provisions. However, after the contractor completed the handover of the indicator in the first year, a group of responsible persons in Kowloon Village concluded that the physical property turned in was not well managed and distributed and that the contractor verbally agreed that the contract should not be turned over
