随着市场经济发展,商誉已成为企业一项重要的无形财产权,愈来愈受到关注,多元化的交易关系加深了商事领域对法治的需求,商誉权也迫切需要相关法律法规的司法确认。较高的信誉水平能够有效的动员和调配社会资源,增进收益并实现社会的良性运转。本文以经济法的视角,结合我国社会主义市场经济的发展现状,对企业自身维护商誉权的内在、外界情势进行了分析与解读。通过对经济法等相关法律的理解与运用,探索如何帮助企业维护自身商誉,从而适应市场经济的发展。
With the development of market economy, goodwill has become an important intangible property right of the enterprise and attracts more and more attention. The diversified trading relationship has deepened the demand for the rule of law in the commercial field. The goodwill right also urgently needs the judicial confirmation of relevant laws and regulations . A higher level of credibility can effectively mobilize and deploy social resources, increase revenue and achieve social benign operation. This article, from the perspective of economic law, combined with the current development of the socialist market economy in our country, analyzes and interprets the internal and external circumstances of the enterprise’s own right to goodwill. Through the understanding and application of relevant laws such as Economic Law, we explore how to help enterprises to safeguard their own goodwill so as to adapt themselves to the development of market economy.
