逮捕是我国五种刑事强制措施中最严厉的一种。从程序上来讲,根据《刑事诉讼法》第59条之规定:“逮捕犯罪嫌疑人、被告人,必须经过人民检察院批准或者人民法院决定,由公安机关执行。”从实体上来讲,根据《刑事诉讼法》第60条之规定:“对有证据证明有犯罪事实,可能判处徒刑以上刑罚的犯罪嫌疑人、被告人,采取取保候审、监视居住等方法,尚不足以防止发生社会危险性,而有逮捕必要的,应即依法逮捕。”从立法的角度上来讲,所有的刑事强制措施都是为了保证诉讼的正常进行,因为我国刑事诉讼中没有缺席审判,为了保证犯罪嫌疑人、被告人的顺利到庭,对其采取强制措施不可避免的在不同程度上限制了其人身自由,但在实际操作中,由于强制措施制度的相对不完善,产生了很多问题,尤其是刑事强制措施中最严厉的逮捕,不仅意味着被逮捕人的人身自由将受到最严格的限制,且法律允许对被逮捕人进行较长时间的羁押,如不能正确适用,则很容易造成超期羁押等严重侵犯被逮捕人权益的情况。本文就我国现有立法对逮捕措施规定中存在的缺陷进行了阐述,对如何完善现有立法中关于逮捕的规定提出了几点建议和思考。

"From a legislative point of view, all criminal coercive measures are intended to ensure the normal operation of litigation because there is no trial of absenteeism in criminal proceedings in our country. In order to ensure that criminal suspects , The defendant’s smooth appearance in court, to take coercive measures inevitably limits to varying degrees the personal freedom, but in practice, due to the relatively imperfect system of coercive measures, resulting in many problems, especially criminal coercion The harshest arrests in the measure mean not only that the personal liberty of the arrested person will be subject to the most severe restrictions and that the law allows a longer arrest of the arrested person Custody between, if not applied properly, it can easily lead to extended detention and other serious violations of the rights of the arrested person. This article elaborates the existing defects in the provisions of the arrest measures in our country’s existing legislation and puts forward some suggestions and reflections on how to improve the existing provisions on arrests in the legislation.
