《反腐敗公約》是國際反腐敗和預防懲治職務犯罪的立法,其有關規定和要求需要通過各簽約國在本國法律中加以規定,由簽約國執法機關在本國範圍內嚴格執行,以發揮其效能,達到預防和懲治國際腐敗的目的。中國除在黨的政策和一系列國家法律文件中貫徹執行《反腐敗公約》的規定、履行國際反腐敗義務,重點是對中國刑法有關條款作適當修改和補充或者解釋,使之與《反腐敗公約》的有關規定相接軌,為懲治和預防國際國內職務腐敗犯罪提供法律依據。
