请求权作为大陆法系民法理论中的重要概念,与诉权和债权等概念既有联系又有区别,应该从理论上予以准确界定。请求权基础分析方法,是通过对请求权规范基础的检索与探寻,分析各种请求权的构成要件,提出最符合权利主体意愿的诉求,从而解决民事纠纷的一种分析方法。通过学习请求权基础分析方法,不但能够把握和理解整个民法的体系,而且可以训练法律思维的形成,提高对实际问题的解决能力,是民法学习者必须掌握的基础性内容。
