为适应司法实践的需求进行司法体制的改革是大势所趋的,量刑制度的改革是司法体制改革的重要内容和价值体现。其中公诉机关的刑建议权能否得到行使及其行使的程度如何是衡量量刑制度改革成效的重要评价指标之一,如果刑事建议权得到充分行使还有利于整个司法制度的发展与完善。量刑制度的改革无论对司法实践而言,还是对理论的创新价值来说都有着积极的意义,但是改革也带来了一系列的问题,例如,新的司法制度在实践检验中出现的操作困难、衔接程度不够等问题也不断凸现出来。目前而言,我国检察建议体制尚不健全,还需要立足于实践进行改革和完善。本文通过在司法实践中的调查和探索,分析了我国量刑制度存在的问题,同时笔者针对我国量刑制度价值的缺失、完善程度不够等问题,提出了合理化的建议和设想。
The reform of judicial system is the trend of the times to meet the needs of judicial practice. The reform of sentencing system is an important content and value embodiment of judicial system reform. Whether the criminal prosecutorial power of the public prosecutor’s office can be exercised or not and how it is exercised is one of the important evaluation indicators to measure the effectiveness of the reform of the sentencing system. If the power of criminal advice is fully exercised, it will be beneficial to the development and improvement of the entire judicial system. The reform of the sentencing system has positive meanings both for the judicial practice and for the innovative value of the theory. However, the reform also brought a series of problems, for example, the operational difficulties of the new judicial system in the practice test , Lack of cohesion and other issues also continue to emerge. At present, the system of procuratorial suggestion in our country is still not perfect, and we still need to reform and perfect it based on practice. Through the investigation and exploration in the judicial practice, this article analyzes the existing problems of the sentencing system in our country. At the same time, the author puts forward suggestions and ideas of rationalization in view of the lack of the value of sentencing system in our country.
