在建筑物区分所有的背景下,业主通过业主自治机构实现物业管理权利。业主自治机构的法律性质如何,直接关系其行为的法律后果,业主的合法权益也与之息息相关。对此,根据对国外物业管理相关立法模式的借鉴与取舍,结合我国法律实践,指出我国物业管理相关立法的现状与不足,提出我国法律构建的建议与思考。
In the context of building differentiation, owners manage their property rights through homeowners’ agencies. The legal nature of the owners autonomous agencies directly affects the legal consequences of their actions, and the owners’ legitimate rights and interests are also closely related. In this regard, according to the reference and choice of the relevant foreign property management legislation model, combined with our legal practice, pointing out the status quo and deficiencies of the legislation related to property management in our country, putting forward suggestions and thinking on the legal construction in our country.
