西方学者认为宪政是法律对政府的限制,毛泽东同志认为宪政是民主的政治。更多的学者认为宪政包含民主、法治、人权三要素。本文从宪政三要素角度对民族区域自治权进行分析,诠释了自治地方在行使自治权过程中,如何通过自主管理本民族、本地区的内部事务而加强民主;如何享有制定自治条例和单行条例的权力,进而遵循宪法至上的理念;如何通过使用和发展本民族语言文字,自主发展教育、科技、文化等社会事业进而保障人权等问题。
Western scholars think that constitutional government is the limit of law to the government, and Comrade Mao Zedong thinks that constitutional government is democratic politics. More scholars think that constitutionalism contains the three elements of democracy, the rule of law and human rights. This article analyzes the regional autonomy of ethnic minorities from the perspective of the three elements of constitutional government and expounds how autonomous regions strengthen their democracy through the independent management of the internal affairs of their own people and the region in the process of exercising their autonomy. Power, and then follow the concept of the supremacy of the constitution; how to independently develop social undertakings such as education, science and technology, culture and thus human rights through the use and development of their own national languages.
