婚姻在中国古代具有非比寻常的意义,涉及两个家族之间的关系,因此婚姻的解除也就非同小可.“和离”作为一项法律制度,首先出现在《唐律》中,规定“若夫妻不相安谐而和离者,不坐”.男女双方被赋予形式上的平等,同时注重感情因素在婚姻中的作用,体现了国家对个人离婚权利的尊重,开创了自由离婚主义的立法例；因和离者“不坐”,国家不对其进行刑罚处罚,表明对个人离婚权利的尊重.
