经济全球化使得经济的发展脱离民族国家的控制,带来了次贷危机等世界经济方面的无政府主义倾向,造成生态环境的大规模破坏,导致人类道德水平的倒退和法律中体现的正义精神的堕落。因此,需要用法律全球化来阻止这一进程。互联网犯罪、环境犯罪和国际刑事法院以及毒品犯罪和反腐败方面的法律全球化的例子表明,迄今为止,这些建立全球性刑法的努力都以失败而告终。在这个过程中,美国秉承其法律上的霸权主义政策向国际社会推行美国的刑法思想,欧洲大陆刑法的基本法律原则未受到应有的尊重。应当在认同不同国家的刑法理念互相妥协与平衡之必要性的基础上,建立一部公平的、充满人文关怀的全球刑法。
Economic globalization has made the economic development from the control of the nation-state and brought about the anarchistic tendencies of the world economy such as the subprime mortgage crisis, resulting in the massive destruction of the ecological environment, leading to the retrogression of the moral standards of mankind and the spirit of justice embodied in the law Fallen. Therefore, legal globalization needs to be done to stop this process. Examples of the globalization of laws on the Internet, environmental crime and the International Criminal Court, as well as on drug-related crimes and anti-corruption show that so far these efforts to establish a global criminal law have ended in failure. In this process, the United States adheres to its legal hegemonist policy and promotes the criminal thinking of the United States to the international community. The basic legal principles of continental law in mainland Europe have not been respected. On the basis of recognizing the necessity of mutual compromise and balance between the criminal law concepts of different countries, a fair and humanistic global criminal law should be established.
