美国等西方国家有大量的基金会,这些基金会大多以各类研究、公共服务、慈善活动为目标而运作。对这些基金会,需要通过表面看到它们的本质:很多基金会名义上是属于全社会所有,但实际上控制在私人手中;基金会的核心利益在于保持家族的长久控制;基金会是富豪和国家共赢的博弈;基金会是各种势力参与政治的一种方式。我们的立法和对境外组织的管理,一定要对他们的背景和性质有深刻的认识。中国在依法治国的大背景下,我们的司法体系不能简单照搬西方,给这些势力留下缝隙,要在维护国家民族根本利益的高度,制定有利于我们的规则。
The United States and other western countries have a large number of foundations. Most of these foundations operate on the basis of various kinds of research, public services and charity activities. For these foundations, their essence needs to be seen on the surface: many foundations are nominally owned by the whole society, but are in fact controlled by private hands; the core interest of the foundations is to maintain the family’s long-term control; the foundations are rich and National win-win game; foundations are a way for various forces to participate in politics. Our legislation and the management of overseas organizations must have a profound understanding of their background and nature. Under the background of governing the country according to law, our judicial system can not simply copy the West and leave gaps for these forces. We must formulate policies that are conducive to our prosperity in the height of safeguarding the fundamental national interests of our country.
