一、纪检机关与检察机关办案过程中的争议 1.受案范围的争议 党的纪律检查机关依照党章、党内政治生活准则、党的方针政策等规定受理案件,检察机关以《刑事诉讼法》等有关法律为依据受理案件。虽然两者各自都有受案范围的规定,但在党员可能有犯罪行为特别是涉及贪污受贿问题的受理上存在争议。一是纪检机关与检察机关都受理;二是纪检机关与检察机关都不受理。
