随着社会的发展,关于高校标识的知识产权争议时有发生,高校名称之争愈演愈烈,不仅仅是名称,高校的校徽通过文字与图画的编排所产生独特的视觉效果,也成为他人擅用的对象,根据《民法总则》对法人的分类,高校属于非营利法人中的事业单位法人,是为实现公益目的而设立的事业单位,应当始终将教育、知识和培养人才放在首位,经济利益不是高校的首要目的,但在市场经济的今天,不管是被动还是主动,高校都会不可避免地参与到市场经济中去,作为市场主体的一部分发挥自己的作用。本文将结合具体案例,就高校名称是否可以取得商标权并如何对其进行知识产权保护做简单的分析。
