对我而言,研究中国传统法最主要的问题是寻得一个恰当立场。中国人从未清楚表达或详细解释他们的法律原则,而中国传统法制与我们的习惯大相径庭,以至于不能单纯地从西方法的术语出发来理解中国的传统法。然而,既然中国传统法制是一套以法典为核心的复杂体系,那么一定存在某种途径可以对其进行研究。~([1])本文展现了作者探寻研究途径的努力,通过对《大清律例》的内在分析,探寻了从中国人的视角研究中国法律原则的可能性。本文仅是这类分析的第一步:对法典中关于“贼盗”篇(在英语中可翻译为theft)的研究。
For me, the most important issue for studying Chinese traditional law is to find a proper position. The Chinese have never clearly expressed or explained their legal principles in detail. However, the Chinese traditional legal system is so different from ours that it is impossible to understand China’s traditional laws simply from the terminology of Western law. However, since China’s traditional legal system is a complicated system centered on the code, there must be some way to study it. This paper presents the author’s efforts in exploring ways of study. By analyzing the “Qing Law”, this article explores the possibility of studying Chinese law principles from the Chinese perspective. This article is only the first step in this type of analysis: a study of the Codex text on “Theft” (translatable as theft in English).
