本文旨在论述国际货物贸易中根本违约对风险转移的影响问题,首先要明确对于风险转移以及根本违约的界定。其次,由于通常情况下,风险转移后,买方因风险遭受的损失由于不是因为卖方的原因引起而应当向承运人或保险索赔,但在卖方根本违约的情况下,由于卖方的过错而使得买卖合同处于不确定的状态,风险的转移问题就更为复杂,需要理清风险转移和根本违约的逻辑联系,重点论述卖家根本违约下的对风险转移的影响,具体问题具体分析。最后得出结论对实际问题进行分析。
The purpose of this paper is to discuss the impact of fundamental breach of contract on risk transfer in international trade of goods.
