清朝乾隆年间,官场上流行一种“议罪罚款”的制度,说白了,就是官员犯了错,上缴一部分“议罪银”便可免罪。这是有明确条文规定的,比如在《钦定吏部处分则例》卷四十八中载明:“官员承问引律不当,将应拟‘斩’‘绞’人犯错拟‘凌迟’,及应拟‘监候处决’人犯错拟‘立决’者,承审官降一级调用,审转官降一级留任,臬司罚俸一年,督抚罚俸六个月。”罚俸开始施行时,主旨只是针对一些较小的过错,在尚不足以撤职、降职的前提下使用一下,让官员感到有点儿
