立法是关乎人世与神世的技艺,其深邃秘密对于人的言辞而言永远都是封闭的。自古希腊贤哲将法律比作金质纽带至卢梭呼吁立法者的超凡脱俗,无不诠释着立法以及立法者的不可或缺。本文基于社会契约论,从“立法者的法理学”维度,分析并明确立法者在共同体中的地位、立法何以实现主权者最大幸福的意图;把握其遭遇“同意”和“智慧”立法基点时,被迫求助于立法者和宗教的无奈;剖析其政治法、民法、刑法、风尚四位一体的立法体系;论证其遵循的普遍性和特殊性相结合的立法原则以及立法更关注“必须破坏的东西”之趋向。
Legislation is about art and worldly life, its profound secrets for the words of the people will always be closed.
