就业是民生之本,是人民改善生活的基本前提和基本途径。现实中就业性别歧视存在,侵害了女性的劳动就业权,规制就业性别歧视有利于和谐社会构建。本文拟从性别就业歧视的角度出发,分析《就业促进法》对女性平等就业权的影响,并且探讨法律中存在的不足之处:未对就业歧视做出定义、未明确违反就业歧视规定的法律责任等。提出解决就业歧视问题,关键还是早日制定专门的反就业歧视法律等,以期推动促进就业法的完善,保障女性就业平等权的实现。
Employment is the foundation of people’s livelihood and the basic prerequisite and basic way for people to improve their living standards. The reality of job sex discrimination exist, violating the women’s right to employment, and regulating employment gender discrimination is conducive to the construction of a harmonious society. This article intends to analyze the impact of Employment Promotion Law on the equal employment rights of women from the perspective of gender employment discrimination and to explore the shortcomings of the law: the definition of employment discrimination is not defined, the law does not clearly violate the provisions of employment discrimination Responsibility and so on. Put forward to solve the problem of employment discrimination, the key is early to develop a special anti-employment discrimination laws, with a view to promoting the promotion of employment law to improve and guarantee the realization of women’s employment equality.
