英美法系中的遵循先例原则是其判例制度中一项重要的原则,是普通法系的核心和基础,具有重要的理论和司法价值。遵循先例原则源自英国,其形成与英国的历史进程、制度发展和民族特性有着不可分割的相关性。由于我国在历史和体制上与英美有着较大不同,因此并不能在我国确立遵循先例原则,但该原则所展现出来的价值和法治精神非常值得我们学习和借鉴。本文从遵循先例原则的概念、历史形成原因和在司法过程中体现出的利与弊等方面,对其进行简要介绍与分析。
The principle of precedent in Anglo-American legal system is an important principle in its jurisprudence and is the core and foundation of the common law system. It has important theoretical and judicial value. Following the precedent principle originated from Britain, its formation is inextricably linked with the historical process, institutional development and national identity in the United Kingdom. Since our country differs greatly from the Anglo-American in history and system, we can not establish the principle of following the precedent in our country. However, the values and the spirit of the rule of law as demonstrated by this principle deserve our study and reference. This article briefly introduces and analyzes the concept of following the precedent principle, the reason of history formation and the pros and cons of the justice process.
