教师申诉制度既是教师权利救济的方式,也是行政监督的方式。教师对涉及本人的考核结果、处分决定等人事处理决定不服的,可以按规定程序向有管辖权的部门申诉。教师申诉的形式有三种:复核、申诉和再申诉,且这三种形式之间是先后的承接关系。教师申诉的处理决定具有行政法上的效力,原处理单位负有执行的义务。
Teacher appeal system is not only a way of relief of teachers’ rights, but also a way of administrative supervision. If a teacher is dissatisfied with the decision of personnel handling involving his assessment result, punishment decision, etc., the teacher may appeal to the competent department according to the prescribed procedures. There are three forms of teacher appeal: review, appeal and re-appeal, and these three forms is the succession of the relationship. The handling of teachers’ appeals has the effect of administrative law, and the original handling unit has the obligation of execution.
