“十二五”时期我国经济发展的关键是加快转变经济发展方式。汽车产业作为制造业的代表一直是我国的支柱型产业,而汽车售后服务作为汽车产业发展的有机组成部分,能否规范化的发展直接影响到汽车行业健康转型。本文旨在从全国第一例汽车消费领域反垄断民事案为视角,分析近年来汽车产业政策与我国竞争政策之间的关系,针对两者在各自发展和相互适应过程中产生的摩擦和间隙,参考欧盟的先进经验,提出相应的协调建议。

As a representative of the manufacturing industry, the automotive industry has always been a pillar industry in our country. As an integral part of the automotive industry, the automotive after-sales service has a direct impact on the healthy transformation of the automotive industry. The purpose of this paper is to analyze the relationship between automobile industry policies and China’s competition policy in the first case of anti-monopoly civil cases in the field of automobile consumption in the country. In view of the friction and gap between the two in their own development and mutual adaptation, Reference to the EU’s advanced experience, put forward corresponding coordination advice.
