【基本案情】1995年5月3日,前山乡政府为落实路旁绿化任务,以栽1棵树付给5元工钱的条件,将栽种2000棵树苗的任务承包给沙河村村民张某。5月18日,有人向县林业局举报,李某责任田头约有100棵树苗被拔掉。5月21日,林业局派员调查此事。在调查过程中,李某向调查人员承认树苗是他拔掉的,但是他又提出如下抗辩理由:张某栽种树苗超出了乡政府的指定范围,将约100棵树苗栽种在他的责任田中。他发现后多次向张某提出异议,张某每次都答应立即移走,但始终没有履行诺言。他自己
