我国1993年《消费者权益保护法》中的“消费者”概念长期应用在传统消费领域,而该概念并没有使用在保险消费领域。但伴随着保险市场的不断发展以及人们对保险产品和保险服务需求量的不断增加,保险领域出现了大量保险公司侵害购买保险产品与服务合法权益的案件。由于我国法学界以及司法界没有确立“保险消费者”概念而使消费者在保险领域得不到倾斜性的保护,因此,本文以“保险消费者”的主体范围界定以及其与普通消费者概念的区别为视角,来对“保险消费者”概念进行合理的法律界定。
