日前,员工状告 TCL 北京电子销售公司(以下简称 TCL)劳动侵权案在西城法院结案,TCL 败诉,原公司员工曹某获得了解除合同时因 TCL 未书面通知而造成的损失。曾某于1999年9月与 TCL 公司签定了为期1年的劳动合同,在此期间,曹某曾代替他人打卡,TCL 根据公司规定,以“严重违反规章制度”口头通知曹某待岗,因曹某怀孕,从1999年12月份开始,公司只发给曹某最低生活费。
